Refer a Friend Terms & Conditions

1. The Promoter

The promoter is Creditfix Limited, incorporated and registered in Ireland with company number 432293 whose registered office is at Avonlea, Demesne, Lucan, Co Dublin and whose principal place of business is at 4 West Regent Street, Glasgow G2 1RW.

2. The promotion

2.1 The title of the promotion is “Refer a Friend”.

2.2 Any existing client of the Promoter will receive a £70 voucher for Amazon where they refer a person to the Promoter regarding an individual voluntary arrangement (IVA) and that referred person, following the referral,

(i) completes an initial advice call with the Promoter and

(ii) a soft credit search is carried out on that referred person (each a Condition and together the Conditions). In the event that neither or one of the Conditions is not completed, the promotion will not be available to the client.

3. How to enter

3.1 The promotion will run from 09:00 on 27/4/21 (the “Opening Date”) to 23:59 on 31/12/22 (the “Closing Date”) inclusive.

3.2 All promotion entries must be received by the Promoter by no later than 23:59 on the Closing Date. All entries received after the Closing Date are automatically disqualified.

3.3 To enter the promotion:

(a) all clients of the Promoter will be sent an email inviting them to share their details including a name, contact number and email address (Referrer).

(b) the client will then receive a unique code and URL which must be shared with the person they are referring (Referee) via SMS, email or social media.

(c) only the client who has shared the link will be eligible for a voucher and not the Referee or any other person who clicks on the unique URL.

(d) there is no cash alternative to the voucher and is non-transferable or refundable.

(e) by clicking on the URL which has been shared by the referrer and filling in their details for debt help, the referee consents to being contacted by a Creditfix advisor.

(f) there is no obligation for the client to refer anyone under this Promotion nor for the Referee to enter a debt solution.

3.4 There is no obligation for the client to refer anyone under this Promotion nor for the Referee to enter a debt solution.

3.5 There is no charge to the relevant client or the Referee for this Promotion.

3.6 The Promoter will not accept:

(a) responsibility for promotion entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the promotion.

3.7 By submitting a promotion entry, you are agreeing to be bound by these terms and conditions.

4. Eligibility

4.1 The promotion is only open to all existing clients of the Promoter as at the Opening Date who are residents in the UK and aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the promotion or its administration; or

(c) any director, member, partner, agent of, or consultant of the Promoter; or

(d) any other person who directly or indirectly controls the Promoter; or

(e) any supplier of goods or services in connection with this promotion; or

(f) members of the immediate families or households of (a) to (e) (inclusive) above.

4.2 In entering the promotion, you confirm that you are eligible to do so and eligible to claim any promotion you may be entitled to. The Promoter may require you to provide proof that you are eligible to enter the promotion.

4.3 The Promoter will not accept promotion entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with; or

(d) incomplete.

4.4 There is no limit on the number of entries to the promotion. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the promotion.

5. Claiming the promotion

5.1 The Promoter will contact each winner of the promotion personally as soon as practicable after determining they are entitled to a voucher, using the telephone number or email address held on it’s records for the relevant client.

5.2 The promotion may not be claimed by a third party on your behalf

5.3 The Promoter will make all reasonable efforts to contact you should you be entitled to a voucher. If you cannot be contacted or are not available, the Promoter reserves the right not to give you any voucher.

5.4 The Promoter does not accept any responsibility if you are not able to take up the promotion.

6. Limitation of liability

6.1 Insofar as is permitted by law,  the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any entrant or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the promotion except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

6.2 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage or disappointment which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the maximum extent permitted by law

7. Data protection and publicity

7.1 The Promoter will only process your personal information as set out in the https://www.creditfix.co.uk/privacy-policy/

8. General

8.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the promotion.

8.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the promotion where it becomes necessary to do so.

8.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
