Can Capital Resolve take me to court?

Technically, yes they can. However, they certainly can’t take you to court straight away, and must have followed a specific process before your debt with themcan progress to that stage.

First, you’ll need to be issued with a default notice. This informs you that you’ve missed payments, and paves the way for a debt collector taking further steps to recover your debt. It also gives you two weeks in which to make up for missed payments. If your debt is at this stage, it’s vital that you make contact with the agency and attempt to set up a payment plan. A default will tarnish your credit file for years.

If they still haven’t been satisfied the debt can be paid, they may apply for a CCJ (county court judgement) against you. If this happens, you must fill in the court paperwork and pay the CCJ or you risk bailiffs being brought in.

What action can Capital Resolve take against me?

Here’s what a debt tracing and recovery company such as Capital Resolve can do if you owe them money:

  • Send collection agents to your address.
  • Add interest and charges to the debt, within the terms of your contract.
